Product Warranty

General

Rotomation products are warranted to be free of defects in materials and workmanship for a period of two years from the date of shipment. If you believe any Rotomation product you have recently acquired has a defect that may or may not have caused the actuator to fail, please contact Rotomation at 386-676-6377 for immediate assistance. If we determine that it is plausible our actuator failed because of a covered warranty issue and the actuator is within its warranty period, we will provide further instructions to submit your warranty claim. Otherwise, you may choose to repair or replace the actuator at your convenience. Once you submit your warranty claim, you may proceed to return your actuator in order to start the warranty evaluation process, in conformance with the statutes expressed hereinafter.

Definitions

  • Buyer - party which directly pays Rotomation for a product or service. Typically, Rotomation buyers are our distributors but occasionally other parties can purchase Rotomation products directly, under special circumstances.
  • End user - party that owns and utilizes a Rotomation product.
  • Customer - any individual or business pursuing a Rotomation product or service, or currently conducting business with Rotomation directly or otherwise. Buyers and end users are Rotomation customers.

Limitations

This warranty does not cover products which, as determined by Rotomation, have been subject to mishandle, misuse, abnormal conditions, abuse or overload, or misapplication, or which have been altered or improperly repaired after shipment.

Electronic sensors are tested by Rotomation prior to shipment, but are not covered by this warranty.

Special actuators that deviate from our standard materials or construction standards or that have been subject to an application, operating condition and/or environment other than their intended purpose as originally agreed to by Rotomation and the customer that established the special requirements may not be covered by this product warranty, as determined by Rotomation.

Rotomation makes no other warranties, expressly or implied. Rotomation specifically disclaims any implied warranties of merchantability or fitness for a specific purpose.

Warranty Claims and Final Resolution

All warranty claims must be directed to Rotomation, Inc. for merit evaluation and to determine appropriate next steps prior to returning any products to Rotomation. Sole remedy to buyer is the repair or replacement of the product, or refund of the purchase price paid by buyer (as shown on the original sales order), at Rotomation’s discretion. End user or current owner of the product in question will need to contact our distributor to discuss the status of the claim and the final resolution.

Shipment Charges

Customer will be solely responsible for transportation charges and insurance fees (if selected) of Rotomation products considered to be defective, F.O.B. to our facility in Ormond Beach, FL. End user is responsible for packing the product being returned properly to prevent damage in transit, whether or not the product is covered by this warranty. See Returns section for important additional information.

Liability

This warranty as stated is the only liability of Rotomation to the buyer or its customers. Rotomation gives no other warranty, express or implied, regarding merchantability or fitness for a particular use. Rotomation will not be liable for any consequential or indirect damages of any kind suffered by the buyer, the end user or any other parties.

Rotomation products are not designed, intended or authorized for use in applications where catastrophic property damage, personal injury or death may occur as a result of product failure, regardless of root cause. If a customer uses any Rotomation products for such unintended or unauthorized application, the customer shall indemnify and hold harmless Rotomation, Inc. and its officers, directors, employees, agents, affiliates, successors, and distributors. Rotomation, Inc. is not responsible for any Rotomation product installation, setup or integration into any other suitable or otherwise component or machine, regardless of level of assistance provided by any Rotomation employee or any instructions available in published literature.
